Assigning a Tenancy
Latest revision date: April 2023
Revision due date: April 2025
Who is this form for?
Please complete this form if you are a secure tenant and you would like to transfer (assign) your tenancy to someone who lives with you and who would have the right to take over your tenancy when you die.
If the person you want to assign the tenancy to is not your husband, wife or civil partner, you will need to supply evidence with your home address which shows that they have lived at your home (see the upload section of this form).
If you do not have your documents to hand then you can photocopy and post them to Berneslai Homes, PO Box 627, Barnsley, S70 9FZ. Please remember to tell us your name and address when sending documents in.
If you transfer your tenancy you lose all your rights as a Berneslai Homes tenant. You would have no security if the person you transfer your home to asked you to leave the property. If this did happen, you probably wouldn’t be given homeless priority on the housing waiting list, as you would be seen to have intentionally made yourself homeless.
Transferring your tenancy can also affect any benefits you receive, such as Concessionary Fuel Allowance and Housing Benefit. Please check this thoroughly before you consider transferring your tenancy to someone else. Once you have transferred a tenancy, you can’t take the tenancy back.
